Dr. Fawaz Khaled Alkhateeb, Assistant Professor at Kuwait International Law School, affirmed that opening the door for women to join the Kuwaiti Armed Forces is consistent with the constitutional and international principle of non-discrimination, which prohibits discrimination on the basis of gender. This principle is grounded in the notion that all individuals are equal in human dignity and are equal before the law in rights and public duties, without distinction based on gender.

Alkhateeb stated to Al-Qabas that the principle of non-discrimination is a general legal principle derived from the concept of equality enshrined in Articles 7 and 175 of the Kuwaiti Constitution, which form fundamental pillars of society. Accordingly, this decision reinforces the values of equality and non-discrimination among individuals. Moreover, women’s participation in the military contributes to strengthening national belonging and loyalty.

He further noted that military service holds a unique value tied to loyalty and service to the nation, as those who serve are protectors of the nation. This value is not linked to gender, particularly in democratic societies. Equality, he emphasized, is not merely a slogan, but a framework in which opportunities and rights are equal, allowing women to participate in society alongside men without bias.

أكد الأستاذ المساعد في كلية القانون الكويتية العالمية د.فواز الخطيب أن فتح الباب للمرأة للانتساب للجيش الكويتي يتماشى مع مبدأ عدم التمييز العالمي والدستوري الذي يحظر التمييز على أساس الجنس، على اعتبار أن الناس جميعا سواسية في الكرامة الإنسانية، وهم متساوون لدى القانون في الحقوق والواجبات العامة، لا تمييز بينهم في ذلك بسبب الجنس.

وقال الخطيب لـ القبس إن مبدأ عدم التمييز قانوني عام مبني على مبدأ المساواة المتأصل في المادة الـ7 والمادة الـ175 من الدستور الكويتي، الذي اعتبره من دعامات المجتمع، وعليه فهذا القرار يرسخ قيم المساواة وعدم التمييز بين الأفراد، فضلاً عن أن مشاركة المرأة في سلك الجيش تساهم في تعزيز الانتماء للوطن.

وأشار إلى أن العمل بالجيش له قيمة خاصة مرتبطة بالوفاء للوطن، باعتبار المنتسب من حماة أرض الوطن، وهي قيمة غير مرتبطة بالجنس، لاسيما في المجتمعات الديموقراطية، والمساواة ليست شعارا، بل هي مركز تتساوى فيه الفرص والحقوق، بحيث تكون النساء مُشاركات في المُجتمع مع الرجال دون تحيّز.
